Higher ceilings for notarial fees

• Poland is raising maximum notarial fees for the first time since 2004.
• A will can cost up to 200 zł and a single-act power of attorney up to 100 zł.
• The amended regulation takes effect on 5 November 2026.

Justice Minister Waldemar Żurek, together with Finance and Economy Minister Andrzej Domański, has signed an amendment to the regulation setting maximum notarial fees. The previous caps dated from 2004. Notaries had asked for the change, saying their costs had risen sharply while many notarial acts had become more complex and time-consuming (Tyle zapłacisz za notariusza. The amended regulation was published in the Journal of Laws on 21 October 2026 as item 1370 and enters into force on 5 November 2026 (Rozporządzenie Ministra Sprawiedliwości z dnia 13 października 2026 r. zmieniające rozporządzenie w sprawie maksymalnych stawek taksy notarialnej – Dziennik Ustaw RP).

What changes for wills and powers of attorney

The ministry says the new caps are meant to better reflect the time, work and responsibility involved in each act, while keeping notarial services accessible. Under the new rules, drawing up a will costs up to 200 zł. A power of attorney for a single act costs up to 100 zł, and one covering several acts up to 200 zł. A will containing an ordinary bequest, a directive or a disinheritance clause can cost up to 300 zł, and one with a vindication bequest up to 400 zł. Other fees

The changes also affect copies and extracts of notarial deeds, certification of document copies, and the fee for submitting an application to enter a change in a land register, which can reach 300 zł. Higher limits apply to the additional surcharge a notary may charge for acts performed outside the office.

Fees for transactions

For property transactions valued above 2 million zł, the scale has also been revised. For values between 2 million and 5 million zł the fee is 6,770 zł plus 0.25% of the excess over 2 million zł. Above 5 million zł the fee is 14,270 zł plus 0.15% of the excess, capped at 25,000 zł, or 15,000 zł where the parties belong to tax group I.

Timing

Clients who want to handle matters at the old rates have until 4 November. From 5 November the higher caps apply.
