Germany moves to set minimum five-year prison term for using K.o. drops in rape or robbery
The Bundestag has passed a reform that treats so-called K.o. drops like weapons and raises the minimum sentence for using them in rape or robbery to five years.

In brief
- The Bundestag has approved a reform raising the minimum prison term to five years for using K.o. drops in rape or robbery.
- K.o. drops will be legally treated like weapons or dangerous tools, after a 2024 court ruling had excluded them.
- The previous minimum was three years, and the law was backed by four factions with the AfD abstaining.
Parliament approves tougher sentencing
Germany's lower house of parliament, the Bundestag, voted on Friday to toughen penalties for the use of K.o. drops, the sedatives typically slipped secretly into a victim's drink. Anyone who uses the substances to commit rape or robbery will face a prison term of at least five years (Niemcy zaostrzają kary za podanie pigułki gwałtu – Deutsche Welle) (K.-o.-Tropfen: Gesetz sieht künftig mindestens fünf Jahre Haft vor – DER SPIEGEL) (Bundestag beschließt härtere Strafen für Einsatz von K.o.-Tropfen – tagesschau.de). The previous minimum was three years. The CDU/CSU, SPD, Left and Green factions backed the reform, while the AfD abstained.
What changes in the law
Under the new rules, the substances will be legally classed in the same way as a weapon or a dangerous tool. Lawmakers said a user who sedates a person in order to resist nothing less than an attack on the victim's ability to defend herself or himself deserves the same treatment as someone armed (Bundestagsbeschluss - K.o.-Tropfen werden künftig ähnlich wie Waffen eingestuft: Was die neue Strafverschärfung bedeutet – Deutschlandfunk). Susanne Hierl of the CDU described the offence as particularly perfidious, noting that most victims are women (Strafjustiz: Bundestag einigt sich auf härtere Strafen für Einsatz von K.o.-Tropfen – ZEIT ONLINE). Carmen Wegge of the SPD said secretly dosing someone removes their chance to fight back.
Response to a court ruling
The reform follows a 2024 decision by the Federal Court of Justice, which held that K.o. drops did not count as dangerous tools under the criminal code. The Bundestag's move closes that gap (Raub- und Sexualdelikte - Bundestag will heute härtere Strafen für Einsatz von K.o.-Tropfen beschließen – Deutschlandfunk).
Why the drugs are hard to prosecute
The main substances are GHB and GBL. Effects range from dizziness and nausea to unconsciousness and memory gaps, and high doses can cause serious breathing problems. Because the drugs leave the body quickly, evidence is hard to secure, according to the victims' group Weißer Ring. Victims often mistake the symptoms for alcohol intoxication.
Critics say the law misses the core problem
The opposition argues the law does not address the heart of the issue (Bundestag plant härtere Strafen für den Einsatz von K.o.-Tropfen – tagesschau.de). Deutsche Richterbund official Rebehn said the higher penalty is appropriate, but that offenders are more deterred by the risk of being caught and convicted than by the length of the sentence.
