What changes from 5 November
Changes to the Labour Code (Kodeks pracy) take effect on 5 November 2026.
Every employer, regardless of how many people it employs, must systematically counter mobbing. The duties cover prevention, detecting mobbing, responding properly, remedial action and support for people affected (Ważne zmiany w prawie pracy od 5 listopada. Tego pracodawcy będą musieli pilnować - GazetaPrawna.pl – gazetaprawna.pl). Employers with at least 10 employees face additional obligations.
Discrimination rules
The Labour Code will explicitly cover discrimination by association and discrimination based on assumption (Szef pomija cię przy awansie? Od 5 listopada ważne zmiany – wp.pl). A single incident can count as discrimination. Examples include passing over an employee for promotion because of age, treating a woman worse because of her sex, or making an unfavourable decision about an employee who cares for a person with a disability.
Compensation amounts
The minimum compensation for breaching the principle of equal treatment is 4806 zł, according to the 2026 rate. In cases of multiple discrimination, the statutory minimum is at least 14 418 zł.
Claims and employer duties
The amendment also clarifies how employees can pursue claims and sets out what employers must do when such claims arise. The new rules apply to all employers from 5 November, while the extra duties for firms with 10 or more staff are tied to the same date.
