President signs law: ZUS to write off pre-1999 debts worth about PLN 315 million
President Karol Nawrocki signed a law that lets the Social Insurance Institution (ZUS) write off contribution arrears dating from before 1 January 1999. The debts total about PLN 315 million, but mortgage-secured claims are excluded.
Write-off of pre-1999 contribution debts
President Karol Nawrocki signed on Wednesday a law that allows the Social Insurance Institution (ZUS) to write off receivables that arose before 1 January 1999 (Będzie umorzenie należności składkowych dochodzonych przez ZUS a powstałych przed 1999 r. – Prawo.pl) (Setki milionów zł zaległości wobec ZUS zostaną umorzone. The Chancellery of the President reported that the signing took place on 4 November 2026 as part of five bills signed that day (Umorzenie należności składkowych dochodzonych przez ZUS a powstałych przed 1999 r. – prawo.pl). The law was passed by the Sejm on 18 September 2026.
Who is affected
The Ministry of Family, Labour and Social Policy estimates that about 7.1 thousand contributors will benefit, with arrears totalling around PLN 315 million (Prezydent podpisał ustawę. The ministry justifies the move mainly by the low effectiveness of collecting claims that are more than 27 years old. According to its impact assessment, many of these obligations can no longer realistically be enforced.
Exclusions
Not all old debts are covered. Receivables secured by a mortgage are excluded from the write-off (ZUS umorzy stare długi. Nie trzeba będzie zgłaszać wniosku – portalsamorzadowy.pl).
When it takes effect
The law enters into force on the first day of the month following five months after its publication in the official journal. Some provisions, including those requiring ZUS to send certain notices, apply 14 days after publication.
Procedure
According to reports, debtors do not need to file an application for the write-off.
