In brief
- A draft act on asbestos-containing products, marked UC60, has been added to the government's legislative work list.
- Property owners would file a single declaration instead of annual reports, updated on sale or dismantling.
- Removal firms would need permits and mandatory staff training, with financial penalties for violations.
Draft act and its goals
The government has added a draft act on products containing asbestos, marked UC60, to the Council of Ministers' legislative work list (Nowe zasady dotyczące azbestu – cozadzien.pl) (Zmiany dla mieszkańców, samorządów i firm. Rząd szykuje nowe zasady dla azbestu – portalsamorzadowy.pl). The bill is meant to bring Polish law in line with European Parliament and Council directives, tidy up existing rules and make asbestos removal and containment safer (Nowe przepisy dotyczące azbestu. Co się zmieni? – Urząd Marszałkowski Województwa Mazowieckiego). At this stage it is a planned solution that still has to go through the parliamentary procedure.
Changes for property owners
For residents, the biggest change concerns record-keeping. Owners would no longer have to report asbestos every year. Instead they would file a single declaration, updated only when the property is sold or when the asbestos materials are dismantled. Local authorities are also expected to see new rules for notifying and registering such products, and the bill would allow some asbestos to be secured permanently in place rather than removed.
Requirements for removal firms
Companies doing asbestos work would need official permits before starting jobs. Their employees would also have to complete mandatory training. The draft provides for financial penalties for violations of the rules.
Asbestos in Mazovia
The draft is expected to change how regional asbestos data is collected and used.
Next steps
The bill now enters the parliamentary process. Its final shape, including penalty levels and transition periods, will depend on changes made during that stage.
